Terms of Sale

Purpose

These Terms of Sale (hereinafter "ToS") govern the sale of subscriptions to Diane AI services, offered by Diane AI.

Any subscription implies unreserved acceptance of these Terms of Sale.

Plans and pricing

Diane AI offers different subscription plans:

• Free plan: limited access to basic features
• Monthly Premium: full access to features, billed monthly
• Quarterly Premium: full access to features, billed every 3 months with discount
• Annual Premium: full access to features, billed annually with discount

Prices are shown in euros including tax. Diane AI reserves the right to change its prices at any time. Price changes do not apply to current subscriptions.

Ordering and payment

Subscription payments are made by credit card through our secure payment provider Stripe.

By placing an order, you guarantee that you are the holder of the credit card used and that it has sufficient funds.

Stripe is PCI-DSS Level 1 certified, the highest level of certification in the payments industry. Your banking details are never stored on our servers.

A payment confirmation is sent to you by email after each successful transaction.

Subscription and renewal

The subscription takes effect immediately after payment validation. Access to Premium features is activated instantly.

Automatic renewal:

• Monthly subscription: automatically renewed each month on the anniversary date
• Quarterly subscription: automatically renewed every 3 months on the anniversary date
• Annual subscription: automatically renewed each year on the anniversary date

A reminder email is sent before each automatic renewal.

Cancellation

You can cancel your subscription at any time from your account settings or by contacting us.

Effects of cancellation:

• The subscription remains active until the end of the paid period
• No further charges are made after cancellation
• You retain access to Premium features until expiration
• After expiration, your account reverts to free mode (your data is preserved)

Right of withdrawal and refund

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content whose execution has begun with the consumer's agreement.

By subscribing to Diane AI, you acknowledge and accept that access to the service begins immediately and expressly waive your right of withdrawal.

Warning: No refund is issued for subscription periods already started, even in case of early cancellation.

Exceptions: a refund may be granted in case of major service malfunction attributable to Diane AI, upon request to our support team.

Liability

Diane AI is committed to providing a service that matches the description of the subscribed plan. The service is provided "as is" without guarantee of specific results.

Diane AI cannot be held liable for:

• Temporary service interruptions for maintenance
• Indirect damages related to the use of the service
• The user's academic results
• Non-compliant use of the service by the user

Disputes and mediation

These Terms of Sale are governed by French law. In case of dispute, an amicable solution will be sought before any legal action.

In accordance with Articles L611-1 et seq. of the French Consumer Code, you may use a consumer mediator free of charge in case of unresolved dispute.

Failing amicable resolution, French courts shall have jurisdiction.
